This Privacy Policy (“Privacy Policy”) applies to our website: https://ailo.us/ (the “Site”) and our applications (collectively, the “Services”), which are owned and operated by AiLO Logistics. This Privacy Policy describes AiLO Logistics’ policies and procedures on the collection, use, and disclosure of your Personal Data (as defined herein) when you access the Site or use our Services. It also describes the choices available to you regarding the use of, your access to, and how to update and correct your Personal Data. We will not use or share your Personal Data with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect from other sources.

“AILO LOGISTICS” may gather personal information for the following purposes:
  • To respond to your requests for further information or follow-up contact;

  • To analyze, develop, improve, and optimize the use, functionality, and performance of our Services and/or the responsiveness of our staff to potential customer inquiries;
  • To understand and predict future changes in our customer’s and potential customers’ needs;
  • To meet any legal and regulatory requirements we may have; and
  • To make queries to social networking and other sites, including but not limited to LinkedIn, for a variety of purposes, including but not limited to verifying your identity and showing you how you are linked or connected to other individuals who are also users of the Services.
The following table provides a list of the information we process:
  • Your name, employer, role with your employer, and contact information;
  • Your professional associations, such as your membership in industry trade groups;
  • Data from any surveys or questionnaires that we may have provided to you;
  • Past requests that you may have made for information from us;
  • Unique IDs such as your mobile device identifier or cookie ID on your browser;
  • Internet Protocol (“IP”) address and information that may be derived from IP address, such as geographic location; and
  • Information about a device you use.
We also collect information about you and the devices you use to access the Services, including:
  • Location Information. Information about where you are located, such as by converting a user’s IP address into a rough geolocation or through GPS or wireless network triangulation to derive your precise geolocation.
  • Device Information. Information about your devices (such as your ELD, your mobile phone, etc.), including the hardware model, operating system, device identifier, and mobile network information.
We may use the information derived from the cookies placed on your device for any of the following purposes:
  • To identify that you have logged in to the Services or visited our Site and to remember that you have visited us or used the Services before;
  • To tell us how and when you interact with the Services and the Site;
  • To monitor aggregate usage and web traffic routing on the Services and the Site; and
  • To customize and improve the Services and the Site.
Cookies and other Tracking

We and our partners use cookies or similar technologies to analyze trends, administer the Services, track users’ movements around the Services, and to gather demographic information about our user base as a whole.

AILO LOGISTICS uses “cookies.” A “cookie” is a small amount of data sent to a user’s web browser from a web server, which is then stored on the user’s hard drive. Cookies are
used to make a user’s experience more efficient, such as making site navigation easier and recognizing a returning visitor. We may store cookies on your device if such cookies are strictly necessary for the operation of the Services. For all other types of cookies, your permission is required.

The Services use different types of cookies. Some cookies are placed by third-party services that appear on our pages. AILO LOGISTICS’ cookies do not generate any Personal Data (as defined below), do not read Personal Data from your computer, and are not tied to any Personal Data. Individuals Under the Age of 18

The Services are not intended for individuals under 18 years of age. No one under age 18 may provide any information on or to the Services. We do not knowingly collect Personal Data from persons under 18. If you are under 18, and unless your consent is given or authorized by the holder of your parental responsibility in accordance with applicable law, you shall not use the Services or provide any information on the Services or through any of their features, register on the Site, use any of the interactive or public comment features of the Site or provide any information about yourself to us. If an individual under 18 has provided Personal Data to us, including his/her name, address, telephone number, email address, or any screen name or username, we encourage the minor’s parent or guardian to contact us to request that we remove the Personal Data from the Services.

What is “Personal Data?”

“Personal Data” means any data that (1) is recorded in any form, (2) is about or pertains to a specific individual, and (3) can be linked to that individual. For example, and without limitation, your first and last names, social media profiles, personal websites, other online materials, any content you post to the Site, IP address, the equipment you use to access the Site, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the Site, usage details, address, email address, telephone number, and other contact information, bank account and payment card details, statements about your wealth and financial situation, investment information, information about your investment objectives, investment experience, prior investments, and the deals in which you have participated are “Personal Data.”

With Whom May AILO LOGISTICS share my Personal Data?

Under certain business or legal conditions, AILO LOGISTICS may have to disclose your Personal Data to others as follows:

  • Within the AILO LOGISTICS organization – AILO LOGISTICS may now or in the future have a parent, subsidiary, affiliate, or related company or companies within the AILO LOGISTICS family of companies. AILO LOGISTICS has the right to share all Personal Data with all such affiliated entities.
  • Service Providers – AILO LOGISTICS may engage other companies and individuals (contractors, service providers, and other third parties) to perform necessary business functions on behalf of AILO LOGISTICS (e.g., customer service, payment processing, developing, operations, sales, support, regulatory and tax filings, data analysis and marketing, or email provider services). If it is necessary to perform these functions, these companies or individuals may have access to Personal Data of our users. These entities have agreed not to use the Personal Data for any other purpose other than providing the required services.
  • Legally Required Disclosure – Under certain circumstances, disclosure of your Personal Data may be required by law. AILO LOGISTICS may disclose your Personal Data (1) if, in its own best judgment, it is required by law to do so in order to comply with a court order, law, legal process, facially valid judicial or governmental subpoena, warrant, bankruptcy proceedings, or other order; (2) to a government institution that has asserted its lawful authority to obtain the information; or (3) when we believe in good faith that disclosure is necessary to protect our rights, property, or safety, as well as to protect your safety or the safety of our customers or others, or to investigate fraud. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
  • Change of Ownership – If ownership of AILO LOGISTICS changes as a result of a merger, acquisition, or transfer to another company, your Personal Data may be transferred to the successor entity. If such transfer takes place, you will be notified of any material changes to the Privacy Policy and will be provided with the ability to opt-out of the transfer of your Personal Data to the successor entity.
Other Disclosures

We may further disclose Personal Data that we collect or you provide as described in this Privacy Policy:

  • to fulfill the purpose for which you provide it;
  • for any other purpose disclosed by Us when you provide the information;
  • with your consent; or
  • to enforce our Terms and Conditions or apply any other agreements, including but not limited to for billing and collection purposes.
May I access or change my Personal Data?

Upon request, AILO LOGISTICS will provide you with information about whether we hold any of your Personal Data. If your Personal Data changes, you may correct, update, or amend by making the change on our member information page or by emailing us at inquiry@ailo.us. If you wish to delete, remove, or deactivate your profile, remove your testimonial from the Site, or opt out of sharing basic application information, please email us at inquiry@ailo.us. We will respond to your request within 30 days.

Data Retention

We will retain your information for as long as your account is active to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

For auditing and security purposes, AILO LOGISTICS may keep a log of all users’ activities, which is retained in its archives as necessary for AILO LOGISTICS to fulfill its obligations. Users may have access to the Personal Data that pertains to them. However, because the administrative and technical burden associated with the retrieval of these archived data is substantial, AILO LOGISTICS charges a fee for this effort in a manner that is consistent with its actual cost. In addition, each user’s right of access may be limited to the extent that providing access might infringe on a third party’s privacy rights. Requests for access to this archived information are handled on a case-by-case basis, after AILO LOGISTICS has verified the identity of the requestor. Users outside the United States

The Services are controlled and operated from the United States. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that we may store the information we collect in the United States, which is not deemed an “adequate jurisdiction” by the European regulatory authorities.  By visiting or using our Services, you are consenting to the transfer of your information from your jurisdiction to the United States.

Limitation of Liability

AILO LOGISTICS exercises reasonable efforts to safeguard the security and confidentiality of your Personal Data; however, transmissions protected by industry standard technology and administered by humans cannot be guaranteed to be secure. AILO LOGISTICS will not be liable for unauthorized disclosure of Personal Data that occurs through no fault of AILO LOGISTICS including, but not limited to, errors in transmission, your failure to comply with your security obligations, and the unauthorized acts of AILO LOGISTICS’ employees.

Use of Personal Data

If at any time AILO LOGISTICS wishes to disclose, or use your Personal Data in a way, or for a purpose other than as described in this Privacy Policy, AILO LOGISTICS will give you the opportunity to choose (opt out) whether your Personal Data (1) may be disclosed to a third party and (2) may be used for a purpose other than the purposes that are set forth in this Privacy Policy. California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Services that are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed. If you are a California resident and want such a list, please send us a written request by email to inquiry@ailo.us with “California Shine The Light Rights” in the subject line.

California Do Not Track Disclosure: We do not respond to Do Not Track browser settings.

California Consumer Privacy Act Disclosures. AILO LOGISTICS is not a business subject to the California Consumer Privacy Act.

Changes in the Privacy Policy

From time to time, AILO LOGISTICS may update this Privacy Policy in order to reflect changes in its practices. Whenever such changes are made, AILO LOGISTICS will post an updated Privacy Policy on the Site and may email registered users. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. Your continued use of the Services after we make changes is deemed to be acceptance of those changes. We encourage you to periodically review this page for the latest information on our privacy practices.

All changes will apply to the Personal Data that is already collected and to Personal Data that is collected after the Effective Date of the revised Privacy Policy and will become effective when posted.

You have the right to terminate your account at any time.

Communication

AiLO Logistics may communicate with you in response to your requests for service or customer support. We will contact you by phone or by email, according to your preference. AiLO Logistics will send you service-related emails if it becomes necessary to do so. AILO LOGISTICS may send you an email to notify you of updates to our Privacy Policy, Terms and Conditions, or other agreement that you have with AILO LOGISTICS. AILO LOGISTICS may also send you an email to notify you of new products, services, or features. If you no longer wish to receive these emails, you may opt out of them by clicking on the unsubscribe button. For system generated emails (in response to you or other AILO LOGISTICS user actions), the majority of such emails are configurable under settings. If you do not want to receive any emails from AILO LOGISTICS, you may opt out by deactivating your account by contacting inquiry@ailo.us.

Governing Law

This Privacy Policy shall be governed in all respects by the laws of the State of California, without regard to conflict or choice of law provisions. Except as otherwise agreed by the parties hereto, you agree that any claim or dispute you may have against us must be resolved by arbitration in the State of California.
